Privacy Policy

This Privacy Policy explains how LISTING AiGENT LLC (“LISTING AiGENT,” “we,” “us,” or “our”) collects, uses, discloses, and safeguards personal information when you use our websites, mobile applications, and services (collectively, the “Service”). By using the Service, you agree to the practices described here and in our Terms of Service.

1. Introduction

LISTING AiGENT provides an AI assistant for licensed real estate professionals. We take privacy seriously and design our Service to minimize the personal information we collect and to protect it in transit and at rest.

2. Information We Collect

Information You Provide. Account details (name, email, brokerage, phone number), listing content you upload or import, calendar availability, payment details submitted to our processor, and any communications you send us.

Voice & SMS Data. When you or a consumer interacts with the AiGENT by phone or text, we collect audio recordings, transcripts, phone numbers, timestamps, and metadata such as call duration and outcome.

Device & Usage Data. IP address, device identifiers, mobile OS version, app version, crash logs, and interaction events (e.g., pages viewed, features used).

Location Data. Approximate (IP-derived) location. We do not collect precise GPS location unless you explicitly enable it for a feature that requires it.

3. How We Use Information

  • Provide, operate, and maintain the Service (including AI call answering, scheduling, and SMS follow-ups);
  • Process payments through Stripe;
  • Improve product quality, reliability, and safety (including model tuning on de-identified data);
  • Communicate with you about account activity, security, and service updates;
  • Detect, prevent, and address fraud, abuse, and violations of our Terms;
  • Comply with legal obligations and enforce our agreements.

We do not sell your personal information and we do not use call recordings or transcripts for advertising.

4. Legal Bases (GDPR)

For users in the European Economic Area or UK, we rely on the following legal bases: performance of a contract (to provide the Service), legitimate interests (to secure, improve, and operate the Service), consent (for optional features and marketing), and compliance with legal obligations.

5. How We Share Information

We share personal information only as needed to provide the Service or as required by law, including with:

  • Service providers such as cloud hosting, telecommunications (Twilio), payment processing (Stripe), analytics, error monitoring, and email delivery, under written agreements requiring confidentiality and appropriate safeguards;
  • AI subprocessors that provide speech-to-text, text-to-speech, and language model inference on our behalf, contractually restricted from using your data to train their public models;
  • Legal and safety disclosures where required by law, subpoena, or to protect rights, property, and safety;
  • Corporate transactions such as a merger, acquisition, or asset sale, subject to this Policy.

6. Payments (Stripe)

All payments are processed by Stripe, Inc. We do not store full card numbers or CVCs on our servers. Stripe processes payment data as an independent controller for fraud prevention and payment services and is subject to its own Privacy Policy.

7. Voice & SMS Data (Twilio)

Voice and SMS traffic is transmitted through Twilio Inc. Twilio processes phone numbers, message content, call audio, and related metadata as our service provider. See Twilio’s Privacy Notice.

You are responsible for obtaining any required consent (including TCPA consent and applicable state call-recording consent) from consumers who interact with your AiGENT. Our default configuration includes an audible disclosure at the start of recorded calls.

Opt-out. Consumers can reply STOP to any SMS to opt out. Standard messaging and data rates may apply.

8. Apple App Store & Google Play

When you download our app from the Apple App Store or Google Play, Apple or Google may collect analytics about downloads and updates under their own privacy terms. Our app follows the Apple App Store’s privacy nutrition label disclosures and Google Play’s Data Safety declarations.

9. AI Processing & Automated Decisions

The Service uses artificial intelligence (including automated speech recognition and large language models) to answer calls, generate replies, and summarize conversations. AI outputs may be inaccurate. You should review important outputs before acting on them. We do not use call recordings, transcripts, or lead data to train third-party public AI models.

10. Data Retention

We retain personal information for as long as your account is active and for a reasonable period afterward to comply with legal obligations, resolve disputes, and enforce agreements. Call recordings and transcripts are retained for up to 24 months by default and can be deleted earlier upon request, subject to legal holds.

11. Security

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit (TLS 1.2+) and at rest, access controls, logging, and regular security reviews. No system is 100% secure; you use the Service at your own risk.

12. Your Rights

Subject to applicable law, you may request to access, correct, delete, or port your personal information; object to or restrict certain processing; and withdraw consent where processing is based on consent. To exercise these rights, email contact@listingaigent.com. We will respond within the time required by law.

13. CCPA / CPRA Notice for California Residents

If you are a California resident, you have the following rights under the California Consumer Privacy Act, as amended by the CPRA:

  • Right to know what personal information we collect, use, disclose, and “sell” or “share”;
  • Right to delete personal information, subject to exceptions;
  • Right to correct inaccurate personal information;
  • Right to opt-out of the “sale” or “sharing” of personal information — we do not sell your personal information;
  • Right to limit use of sensitive personal information;
  • Right to non-discrimination for exercising your rights.

14. Children’s Privacy

The Service is intended for use by real estate professionals aged 18 and older. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact contact@listingaigent.com and we will delete it.

15. International Transfers

We are based in the United States. If you use the Service from outside the U.S., you understand that your information will be transferred to and processed in the U.S. Where required, we use appropriate safeguards, including Standard Contractual Clauses.

16. Cookies & Tracking

We use cookies and similar technologies for essential functions (authentication), analytics (understand usage), and preferences (remember settings). You can control cookies through your browser settings. Blocking essential cookies may impair the Service.

17. Third-Party Links

Our Service may contain links to third-party sites (e.g., Zillow, Redfin, Realtor). We are not responsible for their privacy practices. Review their policies before providing personal information.

18. Do Not Track

Our Service does not respond to “Do Not Track” browser signals at this time. We do not track users across third-party websites for advertising purposes.

19. Changes to This Policy

We may update this Policy from time to time. If we make material changes, we will provide notice through the Service or by email. The “Last updated” date reflects the effective date of the current version.
